I. Scope of application
1 In addition to the ordinary attachment procedure, a notice of attachment is also required in the case of a provisional attachment (Art. 83 DEBA), a supplementary attachment (Art. 110 DEBA) or a subsequent attachment (Art. 145 DEBA). No notice is required for the execution of an arrest or for the retention list.
II. Time
2 Notice of attachment must be given on the day before, but not necessarily 24 hours in advance. Notice must be given during the debt enforcement office's opening hours, and the debt enforcement office must observe any blocking periods and any legal standstill.
3 The time of the attachment must be specified in the attachment document. According to the prevailing opinion, it is sufficient to state the date and whether the attachment will take place in the morning or afternoon (without specifying the exact time). If the debt enforcement office notifies the debtor of the attachment, this notification may, instead of specifying the exact date and time of the attachment on site, also contain a request that the debtor appear in person at the debt enforcement office by a certain time.
4 Failure to give timely notice renders the seizure contestable and may be challenged by means of an appeal (Art. 17 DEBA) against the seizure document. A defective seizure notice can only be remedied if the debtor was able to participate in the seizure or be represented at the seizure.
III. Precautionary measures
5 Precautionary measures (see Art. 98 ff. DEBA) are permissible in urgent cases even before the seizure notice (and also during closed periods, debt collection holidays, and legal standstill).
IV. Service
6 The seizure notice is an order whose service is determined in accordance with the provisions of Art. 34 f. DEBA.
7 The request for continuation generally marks the beginning of a new stage in the proceedings. According to the prevailing doctrine, the so-called deemed service – whereby an uncollected item is nevertheless deemed to have been delivered for the purposes of meeting the deadline – does not apply to the service of the attachment notice.
8 In the opinion of the Federal Supreme Court, however, the fiction of service does apply in principle to the attachment notice if the debtor has not lodged an objection and therefore had to expect the proceedings to continue. The Federal Supreme Court justifies this on the grounds that (unlike in the case of legal enforcement proceedings or notification of bankruptcy proceedings) there is no change in jurisdiction and the proceedings continue to be conducted by the debt enforcement office.
9 The situation is unclear in the case of a legal objection that has been raised and overturned in legal enforcement proceedings. According to the opinion expressed here, even in these cases, the service of the attachment notice is to be assumed to have been effected, as the debtor must expect that a creditor will continue the debt enforcement proceedings after the successful conclusion of a debt enforcement proceedings. It is also conceivable that there may be cases in which the debtor already had to expect service for other reasons and the service is therefore deemed to have been effected.
10 If the debtor refuses to accept the notice, this does not prevent the garnishment notice from taking effect.
11 The addressee of the garnishment notice is determined (even if it is not an actual enforcement document) in accordance with Art. 64-66 DEBA.
12 The garnishment notice is issued using official form no. 5. The creditor is not required to attend the attachment.
V. Effects of the attachment notice
13 The attachment notice does not yet restrict the debtor's power of disposal (cf. Art. 96 para. 1 DEBA). However, the debtor may not frustrate the impending attachment. Such conduct may give rise to criminal prosecution (in particular, possible attachment fraud (Art. 163 SCC) or damage to creditors through reduction of assets (Art. 164 SCC)) or to the opening of bankruptcy proceedings pursuant to Art. 190 no. 1 DEBA.
14 Service of the attachment notice means that the place of enforcement remains unchanged even after a change of residence (Art. 53 DEBA).
