I. History of origins
1 The provision according to which the cantons must publish the lists and refer to the list connections was already found in the National Council Election Act of 1919. When the PRA was enacted, this requirement was taken over, supplemented by the reference according to which the announcement must be made "as early as possible" and "in the cantonal official gazette". An additional paragraph 2 of Art. 32 was included in the PRA with the total revision of the Publication Act of 2004 and adapted to the new requirements regarding necessary candidate information with the PRA revision of 2014.
II. Significance of the provision
A. General
2 The provision regulates the official publication of the lists by the cantonal electoral authorities and the Federal Chancellery.
B. Comparison of laws
3 The cantons have comparable provisions regarding the official publication of the lists in their parliamentary elections. In addition to the lists and candidates, the list connections and sub-list connections must also be indicated (where such connections are permitted at all, cf. OK-Wyler, Art. 31 PRA N. 9 f.).
III. Publication of the lists
A. Cantonal official gazette (para. 1)
4 The cantonal electoral authority shall publicly announce the lists received in the cantonal official gazette. The publication shall mention the list designations and list abbreviations as well as the order numbers, and reference shall be made to the list connections and sub-list connections.
5 The right of voters to have the election proposals (with the references to the list connections) officially published already results from the constitutional right to vote. Official publication serves the free formation of the will of those entitled to vote. It also serves to safeguard the right to ensure that only electable candidates are nominated. With the early official information about all election proposals, those entitled to vote are given the opportunity to take legal action against the candidature of (allegedly) ineligible persons.
6 The law does not specify what information must be provided on the persons standing for election in the publication in the cantonal official gazette. Accordingly, in the publication according to paragraph 1, the persons running for election may (unlike in the publication according to paragraph 2) be mentioned under the names by which they are "known in everyday life or politically" (Art. 22 para. 2 let. b PRA); they will also be listed under these names on the ballot papers. It is also advisable to indicate the year of birth and (as is compulsory for the ballot papers according to Art. 33 para. 1 PRA) the place of residence of the candidates. The publication of the occupation is optional.
7 Publication must take place "as early as possible" and "in the cantonal official gazette". The official publication of interest here refers to the purged lists and takes place after the expiry of the purge period, i.e. at a time when the lists can no longer be changed. In the meantime, the electronic official gazette has become the standard for the cantonal official gazettes.
8 The cantons now regularly publish the lists and the names of the candidates on their cantonal homepages after the submission deadline (election registration deadline). In doing so, they point out that the lists are not yet final and that there is a deadline for corrections. These publications serve to inform the public and the media and do not constitute official publications within the meaning of Art. 32 PRA. After expiry of the adjustment period, the relevant information is updated and official information is published in the Official Gazette.
B. Federal Chancellery (para. 2)
9 According to the provision, the Federal Chancellery also publishes the lists in electronic form. In doing so, it publishes the official names and first names, the year of birth, the home towns and the place of residence of the candidates.
10 This provision was introduced in 2004 with the total revision of the Publication Act. Today, it constitutes the legal basis required by the Publication Act for the (exceptional) publication by the Federal Chancellery of personal data requiring special protection. When publishing the lists for the National Council elections, the public interest in the correct conduct of the election outweighs claims to protection of privacy. The identity of the candidates must be verifiable.
