I. History of origins
1 The first sentence of the provision on the designation of election proposals was editorially only slightly modified from the Federal Law on the Election of the National Council of 1919. In the 2002 revision of the PRA, Article 23 of the PRA was supplemented with the provision that a grouping with several linked election proposals must designate a master list.
II. Significance of the provision
A. General
2 The provision formulates as a requirement for the designation of an election proposal that it be clearly distinguishable from the election proposals of other groupings and any other election proposals of the same grouping. The designation of an election proposal as a master list serves to allocate additional votes on inaccurately designated ballots in the case of groupings that submit several election proposals.
B. Comparison of laws
3 The cantons have identical or comparable provisions in their parliamentary election law regarding the designation of election proposals. Cantons that permit list combinations know similar regulations regarding the designation of master lists for groups that submit several election proposals.
III. Designation of the election proposal
4 Each election proposal must bear a designation that clearly distinguishes it from all other election proposals. This serves, in particular, to inform the eligible voters. The eligible voters must know which list they have before them. As a rule, the election authorities require, in addition to the complete name of the election proposal, an abbreviation or short designation.
5 The election proposals usually come from political parties. However, other groups can also submit election proposals, and even individuals can run in the National Council elections with their own election proposal. In contrast to regulations abroad, there is no party privilege.
6 Two or more parties or groups may also submit a joint election proposal.
7 Parties and candidate groups may submit several election proposals under the same (main) name. These must be distinguished from each other by an addition, an additional designation (Art. 8c para. 1 VPR).
8 Lists with the same designation pursuant to article 31 paragraph 1bis may only enter into a sub-list connection if they differ from each other solely by an addition identifying the gender, the wings of a grouping, the region or the age (cf. in this respect the explanations in OK PRA on article 31 PRA).
9 Groupings which submit election proposals with the same main name, or "identical elements in the main name" and wish to combine them, must, according to Article 23 PRA, second sentence, designate one of the election proposals as the parent list. Article 8c paragraph 3 VPR relativizes this provision and allows an exception: parties and groups with several election proposals do not have to designate a master list in those cases where the distinguishing feature relates solely to the regional delimitation of the lists.
10 The designation of an election proposal as a master list serves in the counting of the allocation of additional votes (blank lines) on insufficient ballot papers designated only with the list main name. In accordance with Article 37 paragraph 2bis PRA, these are allocated to the list that has been designated by the grouping as the master list. As an example: The SP runs in an electoral district with an SP women's list and an SP men's list and designates the SP women's list as the master list. Accordingly, blank lines on a ballot paper filled out manually and marked only with the list designation "SP" are counted as additional votes for the list SP Women.
11 According to Article 37 paragraph 2 PRA, an exception to this rule applies if a party or grouping in an electoral district merely submits several regional lists with the same main designation. In this case, additional votes on an imprecisely designated ballot paper bearing only the main list name shall be allocated to the list in whose region the ballot paper was submitted. The grouping need not designate a master list (cf. marg. no. 9).
12 In practice, the requirements for identical elements in the main designation or for sub-affiliated lists of lists with the same designation are handled differently in the cantons. While some cantons strictly ensure that each of these election proposals is always preceded by the same name or abbreviation, other cantons allow it to suffice if the identical element/name appears anywhere in the name of the election proposal or merely in a parenthesis in the appendix. Several cantons are less strict, particularly in the case of young parties: in many cantons, lists of the JUSO or Jungfreisinnige are regarded as sub-lists of the parent parties SP and FDP and are also admitted to sub-list combinations with these, even if, strictly speaking, no lists with "identical elements in the main designation" or "lists with the same designation" can be identified. This no longer corresponds to the wording of the provisions, but also does not mislead the electorate, as they should be aware that the JUSO belongs to the SP and the Jungfreisinnige to the FDP.
13 The designation of the election proposal cannot be changed after it has been submitted to the canton, unless it gives rise to confusion. In such a case, the electoral authority, as part of the rectification of deficiencies in the adjustment procedure pursuant to Article 29 PRA, shall set a deadline for the representation of the election proposal within which the designation must be changed.
